Welcome to Snap Magic PhotoBooths. These Terms and Conditions outline the rules and regulations for the use of our website and services. By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. Interpretation and Definitions

Company refers to Snap Magic PhotoBooths, a business based in Melbourne, Victoria, Australia (referred to as “Snap Magic PhotoBooths”, “we”, “us”, or “our”).
Client refers to you, the individual or entity booking our services or accessing our website.
Services refer to any photo booth rental, digital or physical prints, props, backdrops, or related services provided by Snap Magic PhotoBooths.
Event refers to the specific date, time, and location for which you have booked our services.

2. Use of Our Website

By accessing and using our website, you confirm that you are at least 18 years old or accessing under the supervision of a parent or guardian. You agree not to misuse our website, upload harmful material, or engage in any activity that could damage or disrupt the site.

We may modify or remove any part of the website without prior notice and are not liable for any resulting consequences.

3. Booking and Payment

  • All bookings are subject to availability and confirmation.
  • A deposit (as specified during booking) is required to secure your booking. Bookings are not confirmed until the deposit is received.
  • The balance must be paid by the date specified in your booking confirmation, typically no later than 7 days before the event.
  • Prices quoted include GST unless otherwise stated.
  • Failure to complete payment may result in cancellation of your booking.

4. Cancellation and Refund Policy

  • Cancellations made 30 days or more before the event will receive a full refund of any deposit paid.
  • Cancellations made less than 30 days before the event may forfeit the deposit.
  • In the unlikely event we must cancel due to unforeseen circumstances, you will receive a full refund of all payments made. We will not be liable for any additional costs or damages arising from such cancellation.

5. Service Conditions

  • The client is responsible for providing suitable space, power supply, and safe access for the setup and operation of the photo booth.
  • Snap Magic PhotoBooths reserves the right to refuse setup or operation if conditions are deemed unsafe or unsuitable.
  • The client must ensure that the venue permits photo booth setup and that all necessary permissions are obtained.
  • Children must be supervised at all times while using the photo booth.

6. Use of Photos and Videos

By using our services, you grant Snap Magic PhotoBooths permission to use photos and videos taken during your event for promotional and marketing purposes, including on social media and our website, unless you notify us in writing prior to the event that you do not consent to this.

All digital photos remain the property of Snap Magic PhotoBooths. Clients may use the photos for personal, non-commercial purposes.

7. Equipment Care and Responsibility

  • Clients are responsible for any damage to equipment caused by guests or attendees during the event, beyond normal wear and tear.
  • In the event of damage, the client may be charged the repair or replacement cost.
  • We will make every reasonable effort to ensure our equipment functions properly throughout the event. However, we are not liable for minor interruptions or technical issues that are beyond our control.

8. Liability

Snap Magic PhotoBooths will not be held liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim, whether in contract, tort, or otherwise, will not exceed the total amount paid by the client for the booking.

We are not responsible for delays or non-performance due to circumstances beyond our control, such as accidents, venue issues, natural disasters, power outages, or other events classified as force majeure.

9. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

10. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The updated version will be posted on this page, and the “Last updated” date will be revised accordingly. Continued use of our services constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
